Every day I am receiving phone calls from aggressive creditors regarding overdue bills, such as credit card bills. Can I stop them from calling me?

The Fair Collection Debt Practices Act protects consumers and prevents harassing and excessive contacts from debtors. Although creditors do have the right to contact in regards to a past due debt, there are limits under the law that prevent creditors from being too aggressive.

These limits include contacting the consumer by telephone too early in the morning or late at night; repeated phone calls to the consumer; continuous calls, after the consumer has requested the creditor to contact them in other ways (such as by mail); contacting the consumer at their place of employment; abusive or profane language, etc. If you opt to file for bankruptcy, under the law, creditors can no longer contact you directly and must contact you only through your attorney.
